Real estate and divorce: keep or sell your property?

In the event of a divorce, there are various options as to what can happen to the shared house, for example:
» Both move out and sell the property:
The proceeds generated can probably be used to pay off the remaining loan. Maybe there will be something left over that can be divided between the ex-partners, giving both of them a fresh start. That would be the simplest and most uncomplicated solution.
» One partner wants to stay in the property:
One partner can then pay out the other and the property becomes his sole property. However, disagreements often arise about the value of the property, which the person moving out usually estimates to be higher than the person staying. There is also the question of who should or has to move out and who can keep the property.
» Keep the property:
Of course, there is also the option of continuing to own the property together and, for example, renting it out. However, this is only recommended if the separation is somewhat amicable.

We were able to successfully help these (ex)partners with their divorce property
To give you a more precise idea of how the process of selling property in the event of a divorce can work, you can read the stories of three couples here for whom we were able to successfully mediate.
There are divorces that are quite peaceful and then there are also divorces that are really bad. In one case we were dealing with a full-blown War of the Roses.
In this case it is a married couple who bought an apartment during their marriage and lived in it – so they were both owners. But during the marriage, the man had already sold her the right to occupy the apartment to the city. This means that the owner must then rent the apartment to socially disadvantaged families at a capped rent for 15 years. Of course, this puts a lot of pressure on the selling price. At the same time, the bank put pressure on because the installments for the home loan were no longer being paid.
Now the divorce was finally imminent and we were commissioned as brokers to sell the apartment. The big difficulty here was that the couple no longer wanted to meet under any circumstances. So we took on the role of mediator and negotiated with each of them individually. We took over all the tasks involved in selling the property – gathering documents, taking photos, etc. – and started marketing.
Thanks to skillful marketing and a good deal of negotiating skills, we were able to achieve a reasonable price in the end despite the right to document. Due to the couple’s enormous disputes, we also took over the notary appointment so that the two of them didn’t have to face each other alone.
Another couple’s divorce was a little more leisurely, but not entirely without conflict. She also bought an apartment during the marriage and now had to decide what should happen to it.
She wanted to sell and he wanted to rent. With this disagreement, you came to us and commissioned us as your broker. The first thing we did was carry out a comprehensive property valuation, which we used to discuss the options and potential of the apartment. At the end of the calculation it was clear that a sale would be most worthwhile. Especially since if he wanted to rent out the apartment, he would have had to pay out his ex-partner and he didn’t have the money to do that.
So in the end the apartment was sold. We took care of all tasks, from creating the exposé to marketing and handing over the keys, and were able to successfully complete the sale within just a few weeks.
The case of a couple who had planned and built a new apartment in the Europaviertel together, but separated just two years after moving in, was quite tragic.
We were commissioned by the couple to sell the apartment under optimal conditions. Both were owners of the apartment and had been terribly at odds since the separation. So a sale was the right solution, because otherwise one would have had to pay out the other. Alternatively, if you had continued to share, you would still have had something to do with each other.
