Lawyer or notary when buying a property: which role does which play?
As a property buyer in Germany, it is advisable to consult both an experienced lawyer and a competent notary to ensure a smooth and legally secure property purchase.
Both are indispensable partners when buying a property to ensure that all legal aspects are taken into account.
A lawyer represents the interests of their clients and advises them on legal issues relating to the property purchase. He checks the purchase contract, monitors the sales process and assists the buyer with legal questions. They can also provide support in negotiations with the other party or other parties involved.
The notary is an independent holder of a public office. His main task is to ensure legal certainty for the property purchase. The notary notarises the purchase contract, ensures that all legal requirements are met, verifies the identity of the contracting parties, clarifies open questions and provides information on possible legal consequences. The notary also prepares the entry of the change of ownership in the land register. His role is to act neutrally and impartially and to secure the legal framework of the property purchase.
